1. General information only
Everything on this Site, including articles, photos, plans, renderings, process descriptions and pricing information, is general information provided in good faith. It is not architectural, engineering, legal, financial or construction advice. We try to keep the Site accurate and current, but we make no warranty that it is complete, accurate or up to date. You rely on it at your own risk.
2. Who we are and what we do
Empyreal is a residential building designer. Our designers are not licensed architects, professional engineers or land surveyors, and Empyreal is not a licensed residential builder or contractor. We design detached one- and two-family homes, additions and remodels.
We do not:
- provide structural, mechanical, electrical or plumbing engineering, or size those systems;
- provide land surveying or determine property lines, setbacks or flood and wetland boundaries;
- stamp or seal drawings;
- prepare or file permit applications;
- perform, supervise or inspect construction.
We gladly refer clients to licensed surveyors, engineers and builders, who contract with and bill the client directly. Some projects, and some jurisdictions, require a licensed architect’s or engineer’s seal. It is the owner’s responsibility to confirm what their jurisdiction requires.
3. No client relationship until we both sign
Contacting us, calling us or submitting the intake form does not create a client relationship. A client relationship begins only when a written proposal or design agreement is signed by both parties and any required payment is received. The terms of that agreement govern our services.
4. Pricing
Any prices or fee information on this Site are non-binding estimates for general budgeting only. They are not a quote, bid or offer. Your actual fee depends on the scope, site, existing conditions, level of detail and selections confirmed during Design Discovery, and is set only in a signed proposal. Prices may change without notice. Fees for surveyors, engineers, agencies and other consultants are separate and not included.
5. Portfolio, plans, renderings and examples
Projects in our portfolio come from our own client work, used under the portfolio terms in our design and drafting agreements. We don’t publish a client’s name, street address or personal information without their consent. Plans are shown without addresses, and some details may be changed or left out for privacy and security. If you have a privacy concern about a project shown, please contact us.
Projects, photos, floor plans and renderings on this Site are examples of past or conceptual work. They show what may be possible, not a guarantee of any result, cost, schedule or approval.
- Renderings and 3D views are artistic representations and not to scale.
- Built projects may differ from the drawings shown.
- Some photos may show work built by others from our designs.
- Construction quality is the builder’s responsibility.
6. Plans, codes and local conditions
Building codes, zoning, snow loads, soils, septic and well rules, shoreline and wetland rules differ by location and change over time. Information on this Site about codes or regulations is general. It may not apply to your property and is not a substitute for checking with your local building, zoning, health and environmental officials. The authority having jurisdiction has the final say.
7. Construction cost and budget information
Any discussion of construction cost on this Site is general. Construction costs vary widely with materials, labor, site conditions and market changes. We don’t guarantee construction cost and are not responsible for builder pricing.
8. Testimonials
Testimonials reflect the real experiences and opinions of individual clients. Results vary from project to project, and we do not claim that every client will have the same experience. Testimonials may be edited for length, spelling or grammar. Clients aren’t paid for testimonials.
9. Third-party links and recommendations
The Site may link to, or mention, other businesses such as surveyors, engineers, suppliers, builders, manufacturers and government agencies. We don’t control those sites or businesses. A mention or link isn’t a guarantee of their work, products or information. Your dealings with them are solely between you and them.
10. Copyright and intellectual property
All content on this Site belongs to Empyreal Home Design, LLC or is used with permission, and is protected by U.S. copyright and trademark law. This includes text, designs, floor plans, drawings, renderings, photos, graphics, logos and the Empyreal name.
- Floor plans and designs are protected as architectural works.
- You may view and print pages for your personal, non-commercial use.
- You may not copy, reproduce, modify, distribute, sell, or use any plan, design or image from this Site to build, draw or market a building, or to create derivative works, without our written permission.
- Infringement may result in a claim for damages, including statutory damages and attorney’s fees where available under federal law.
11. Information you send us
When you contact us or submit the intake form, we collect the information you provide, such as your name, contact details, project address, project details, photos and documents.
- We use it only to respond to you, evaluate and carry out your project, and run our business.
- We may share it with consultants working on your project, such as a surveyor or engineer, only as needed for the project.
- We do not sell your personal information.
- The Site and its hosting provider may use cookies and basic analytics to operate and improve the Site. You can disable cookies in your browser, but some features may not work.
- No method of transmitting or storing data is 100% secure.
- Please don’t send financial account numbers or other sensitive personal information through the Site.
- To have your information removed, email us. We’ll remove it unless we’re required to keep it.

12. Limitation of liability
To the fullest extent permitted by law, Empyreal Home Design, LLC and its owners, employees and contractors are not liable for any direct, indirect, incidental, consequential, special or punitive damages arising from your use of, or reliance on, this Site or its content. This includes lost profits, loss of opportunity, property damage or construction costs, whether based on contract, negligence or any other theory, even if we were advised of the possibility of such damages. The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the Site will be uninterrupted, error-free or free of viruses.
13. Indemnity
You agree to indemnify and hold harmless Empyreal Home Design, LLC and its owners, employees and contractors from any claims, losses, damages and expenses, including reasonable attorney’s fees, arising from your misuse of the Site, your violation of these terms, or your infringement of any third party’s rights.
14. Age
The Site is intended for adults 18 and older. We do not knowingly collect information from anyone under 18.
15. Changes
We may update this Site and these terms at any time without notice. Changes take effect when posted. Your continued use of the Site means you accept them.
16. Governing law
These terms are governed by the laws of the State of Michigan. Any dispute will be brought in the courts of Grand Traverse County, Michigan. If any part of these terms is unenforceable, the rest remains in effect.
